Terms of Use

1. Agreement to these Terms
Dark Monitor (the “Service”) is operated by PWN-ALL Auditing, Reviewing & Testing Cyber Risks CO. L.L.C (“PWN-ALL”, “we”, “our”, “us”), 145, Al Mustaqbal street, Iris Bay Tower 2101-11, Business Bay, Dubai, United Arab Emirates — pwn-all.com.
By accessing or using the Service you agree to be bound by these Terms of Use, our Privacy Policy and our Disclaimer, which are incorporated into these Terms by reference. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
2. The Service
The Service lets you check whether an email address appears in our index of known data breaches, and — for account holders — monitor an address for future exposure and receive alerts. Anonymous checks are privacy-preserving by design: the address is cryptographically blinded in your browser and never reaches our servers in readable form. The Service is available in three ways:
- Anonymous checker — check an address from the home page, subject to rate limits.
- Individual account — monitor your own verified account email and receive alerts.
- Organization account — an organization can monitor mailboxes on domains it has verified it controls, and receive alerts for its employees (section 6).
3. Eligibility
You must be at least 16 years old (or the age of digital consent in your jurisdiction, if higher) and legally capable of entering into these Terms.
4. Acceptable use
You agree that you will only check or monitor email addresses you own or are explicitly authorized to check or monitor. In addition, you must not:
- use the Service to investigate, profile, harass, or stalk any other person;
- monitor a domain or mailbox you do not control or are not authorized to monitor;
- attempt to bypass, disable or burden the proof-of-work captcha, rate limits, or any other protection measure;
- access the Service by automated means (bots, scrapers, bulk calls) except through the API we provide, used within its documented limits;
- attempt to reverse, brute-force, or otherwise de-anonymize the breach index, its tokens, or any other user’s data;
- probe, scan, or test the vulnerability of the Service without our prior written authorization (responsible disclosure reports are welcome at security@pwn-all.com);
- resell, sublicense, or provide the Service to third parties as a service of your own, except as expressly permitted for an organization’s own internal use;
- use the Service in violation of any applicable law or regulation.
5. Accounts and sign-in
An account is tied to the email address you provide. You are responsible for providing an address you control and for the security of that mailbox — one-time sign-in (magic) links sent to it grant access to your account. Keep your credentials, API keys, and any single sign-on configuration secure. We may decline, suspend, or remove accounts at our discretion, including for violations of these Terms.
6. Organization accounts
If you create or administer an organization account, you additionally agree that:
- you are authorized to act for the organization and to monitor the domains and mailboxes you add;
- you will only add domains the organization controls, and you must verify control of each domain (by publishing the DNS record we specify) before its mailboxes are monitored;
- the organization is the controller of its employees’ and members’ personal data processed through the Service, and is responsible for having a lawful basis for that monitoring and for providing any notice to, or obtaining any consent from, the affected individuals that applicable law requires;
- you are responsible for the members, roles, API keys, outbound webhooks, and single sign-on / SCIM connections you configure, and for any endpoint or identity provider you direct the Service to send data to;
- the organization’s owners and admins can access exposure information about the organization’s monitored mailboxes.
We act as the organization’s processor for this data, as described in the Privacy Policy.
7. Plans, billing, and cancellation
The anonymous checker is provided free of charge. Monitoring and organization features may require a paid subscription. Paid plans are billed through our payment processor, Stripe; by subscribing you also agree to Stripe’s terms. Subscriptions renew automatically for successive periods until cancelled, and organization plans are billed per seat. You may cancel at any time; cancellation stops future renewals and, at the end of the current paid period, ends the associated monitoring entitlement. Except where required by applicable law, fees already paid are non-refundable. We may change prices or plan features on a prospective basis, with notice for material changes.
8. Availability and changes
We may change, limit (including check limits), suspend, or discontinue any part of the Service at any time. For paid plans we will act reasonably and give notice of material changes where practicable. We are under no obligation to maintain, update, or keep the breach index complete or current, and alerts depend on data we hold and on email delivery, which we do not guarantee.
9. Intellectual property
The Service, including its design, software, text, and branding, is owned by PWN-ALL or its licensors and protected by applicable intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose. Any feedback you send us may be used without restriction or compensation.
10. Third-party data and services
Results are derived from third-party breach data and public sources. We are not affiliated with, endorsed by, or responsible for any breached service referenced. The Service also relies on third-party providers (including a payment processor and an email provider) and, at an organization’s direction, delivers data to endpoints and identity providers the organization configures. See the Disclaimer and Privacy Policy for details.
11. Warranties and liability
The Service and all results are provided “as is” and “as available”, without warranties of any kind, express or implied. To the maximum extent permitted by applicable law, PWN-ALL accepts no liability whatsoever in connection with the Service, as set out in full in section 6 of the Disclaimer, which forms part of these Terms.
12. Indemnification
You agree to indemnify and hold harmless PWN-ALL and its officers, directors, employees, contractors, agents, and affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service in violation of these Terms or of applicable law, including checking or monitoring identifiers or domains you were not authorized to check or monitor.
13. Termination
You may stop using the Service at any time and may export or delete your account data as described in the Privacy Policy. We may suspend or terminate your access at any time for any reason, including breach of these Terms. Sections 9, 11, 12, 14 and any provisions that by their nature should survive will survive termination.
14. Governing law and disputes
These Terms are governed by the laws of the United Arab Emirates as applicable in the Emirate of Dubai, without regard to conflict-of-law rules. Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates, unless mandatory consumer protection law in your country of residence provides otherwise.
15. Changes to these Terms
We may update these Terms as the Service evolves. The “Last updated” date above always reflects the current version; material changes will be announced on the site. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
